The Customer therefore acknowledges and agrees that Items may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Items ordered in a single order and the number of individual Orders placed for the same product that reflect the typical quantity purchased by an average consumer. AIT MANOS FRANCE reserves the right to refuse an order that is clearly placed by a professional seller.
All Customers acknowledge that they are aware of the unreliability of the Internet, particularly with regard to the relative security of data transmission, the lack of guaranteed continuity in access to the Site, the lack of guaranteed performance in terms of data transmission volume and speed, and the risk of virus propagation. AIT MANOS FRANCE advises each Customer of the need to implement security solutions and measures on their computer, laptop, or mobile device to prevent the spread of viruses.
4. CREATING A CUSTOMER ACCOUNT
A customer account is created by filling out the form provided to the Site user. This account is strictly personal and allows the user to log in before confirming each Order.

If the chosen username is already in use, the system will prompt the Customer to select another one.
Usernames and passwords are personal and confidential. While AIT MANOS FRANCE takes all necessary precautions and is committed to protecting its Customers’ personal data, the Customer is advised to keep their password confidential and not to disclose it to any third party under any circumstances.
If the Customer suspects that a third party is using their username and password, they must immediately notify AIT MANOS FRANCE in order to change their password and/or choose to close their customer account.
AIT MANOS FRANCE reserves the right to close any customer account and, consequently, to refuse any sale to a Customer in the event of non-payment of one or more previous Orders.
In this case, AIT MANOS FRANCE will send an email to the affected Customer at the address provided by the Customer when creating their account, informing them that their username and password have been deactivated and that their account has been closed. The Customer is granted eight (8) calendar days’ notice so that they may, if necessary, submit their comments to AIT MANOS FRANCE, without prejudice to the suspension of their Account during the notice period.
Generally speaking, the Customer is informed that their account may be closed following the Customer’s first request sent via email to AIT MANOS FRANCE.

Once the Order has been dispatched, the Customer is informed by e-mail that his invoice, including delivery charges and VAT applicable on the day of the Order, is available online in his customer account.Transactions carried out on the Site are entrusted to a secure online payment platform, STRIPE.
This solution features highly secure pages for entering payment data: card number, expiry date and visual cryptogram.

The contract—and therefore the sale—will be considered terminated upon AIT MANOS FRANCE’s receipt of the email or letter in which the Customer informs AIT MANOS FRANCE of their decision, unless delivery has occurred between the time the Customer sent the email or letter and the time AIT MANOS FRANCE received it.
In the event that the Order is definitively canceled, the Customer will receive a refund of the price paid for the Order within 14 days following the date of cancellation by the Customer.

12. WARRANTIES
The Articles are guaranteed against the defects of conformity and the redhibitory defects under the conditions envisaged in articles 1641 to 1649 of the Civil code and L 2171 and following of the Code of consumption, and this as from the delivery:
Warranty Against Hidden Defects
Article 1641 of the Civil Code: The seller is liable for hidden defects in the item sold that render it unfit for its intended use, or that so impair such use that the buyer would not have purchased it, or would have paid only a lower price for it, had the buyer known of them.
Article 1643 of the Civil Code: The seller is liable for hidden defects even if he was unaware of them, unless, in such a case, he has stipulated that he shall not be bound by any warranty.
Article 1644 of the Civil Code: In the cases covered by Articles 1641 and 1643, the buyer may choose either to return the item and receive a refund of the purchase price, or to keep the item and receive a partial refund of the purchase price.
Article 1646: If the seller was unaware of the defects in the item, the seller shall be liable only for refunding the purchase price and reimbursing the buyer for any expenses incurred in connection with the sale.
Article 1648, paragraph 1, of the Civil Code: The buyer must bring an action for latent defects within two years of discovering the defect.
Legal Warranty of Conformity
Article L 217-4 of the Consumer Code: The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the contract or was carried out under the seller’s supervision.
Article L 217-5 of the Consumer Code: The goods are in conformity with the contract
1/ If they are fit for the purpose usually expected of similar goods and, where applicable:
If they correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
Whether it possesses the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or on labeling
2/ Or if it possesses the characteristics mutually agreed upon by the parties or is suitable for any special purpose sought by the buyer, which was brought to the seller’s attention and which the seller accepted.
Article L. 217-7, paragraph 1, of the Consumer Code: Any lack of conformity that becomes apparent within twenty-four months of delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise.
Article L. 217-9 of the Consumer Code: In the event of a lack of conformity, the buyer may choose between repair and replacement of the goods. However, the seller may refuse to comply with the buyer’s choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. The seller is then required to proceed, unless it is impossible to do so, according to the option not chosen by the buyer.
Article L. 217-10 of the Consumer Code: If repair or replacement of the goods is impossible, the buyer may return the goods and receive a refund of the purchase price, or keep the goods and receive a partial refund of the purchase price. The same option is available to the buyer:
1/ If the solution requested, proposed, or agreed upon pursuant to Article L. 217-9 cannot be implemented within one month of the buyer’s complaint;
2/ Or if such a solution cannot be implemented without causing significant inconvenience to the buyer, given the nature of the goods and the use the buyer intends to make of them.
However, the sale may not be rescinded if the lack of conformity is minor.
Article L 217-11 of the Consumer Code: The provisions of Articles L. 217-9 and L. 217-10 apply at no cost to the buyer. These same provisions do not preclude the award of damages.
Article L 217-12 of the French Consumer Code: The statute of limitations for claims arising from lack of conformity is two years from the date of delivery of the goods.
The Customer may contact AIT MANOS FRANCE via the contact form on the Website to obtain any information regarding the exercise of these warranties. In accordance with Article 23 of these Terms and Conditions, the Customer shall first contact AIT MANOS FRANCE to seek an amicable resolution when the Customer intends to invoke one of the aforementioned warranties.

Thus, these elements constitute evidence and, if produced as evidence by AIT MANOS FRANCE in any litigation or other proceeding, shall be admissible, valid, and enforceable in the same manner, under the same conditions, and with the same probative value as any document that would be drawn up, received, or retained in writing.
